The International Telecommunication Union (“ITU”) welcomes you to the ITU Academy website, located at www.academy.itu.int (the “Website”). The Website is intended to serve as the main online gateway to ITU’s capacity development activities and contains educational, learning and academic material, including, but not limited to, material related to training courses and workshops (collectively, “Trainings” and each a “Training”).

By accessing and using the Website, you agree to abide by these terms, conditions and notices (collectively, “Terms”). ITU reserves the right to modify and update these Terms at any time, and in such an event, it will post a corresponding information notice on the Website.

1. Creation of ITU Academy accounts and registration for specific Trainings; Website content and Trainings

An ITU Academy account (“Account”) is required to access certain content on the Website. Creating an Account is free but you must be at least 18 years old to create one. Certain Training-related content is available only upon registration for the corresponding Training, which is done by using your Account. Details of each Training, such as its duration, curriculum, and applicable Training fees, if any, are included in the relevant Training outline, also published on the Website.

The training courses are open for applications from all interested professionals, irrespective of their race, ethnicity, age, gender, religion, economic status and other diverse backgrounds. We strongly encourage registrations from female applicants, and applicants from developing countries (includes least developed countries, small island developing states, landlocked developing countries).

Through the Website, you will have the ability to access and/or use content and Trainings provided by ITU and by third parties, such as the ITU Academy Training Centres or other entities with which ITU has ongoing licensing or collaboration arrangements. Accessing or using this content and Trainings may be subject to additional terms and conditions, which are stipulated in the corresponding third-party license, proprietary notice, or the Training outline. Furthermore, certain content or Trainings found on the Website may contain advices, opinions and statements of third parties. ITU does not represent, warranty or endorse the accuracy or reliability of any such third party advice, opinions, statements or other information.

Unless otherwise explicitly indicated in a Training outline, participation in or completion of a Training does not confer any academic credit, and even if such credit is awarded by the provider of the Training, there is no presumption that it will be acknowledged by third parties.

2. Accessing the Website; Availability of Website content and Trainings

You are responsible for making the necessary arrangements to access the Website. Should you decide to create an Account, you agree that you will be solely responsible for maintaining the confidentiality of your Account and password, and that you accept responsibility for all activities occurring under your Account. You also accept that the information you provide to the Website (whether for creating your Account or at any other time) is true, accurate, and kept up-to-date. Please contact ITU at hcbmail@itu.int if at any moment you have reason to believe that your Account is no longer secure. Please note that although ITU takes various organizational and technical measures to protect your Account data and related information, it cannot guarantee that third parties will not gain unauthorized access to your Account data or related information.

ITU will not be responsible if, for any reason, the entire Website or certain content or Trainings become unavailable for an indefinite period. ITU reserves the right to withdraw or amend the Website, or to modify, update or remove any content or Trainings found on the Website, at any time and without advance notice.

Furthermore, the ITU also reserves the right to refuse access to the Website to any individual who violates the present Terms.

3. Intellectual Property Rights; area nomenclature and designations

Notwithstanding Section 4 below, the Website and its entire content, features, and functionality (including but not limited to all Trainings, information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof) are owned by ITU, its licensors or other providers of such material, and are protected by international and national copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. Unless you are a Training provider, the present Terms permit you to use the Website and its content for your personal use only. No right, title or interest in or to the Website or any content on the Website is transferred to you, and all rights not expressly granted, are reserved by ITU, its licensors or other providers of said materials, as the case may be. Unless expressly indicated on the Website that a particular item of the Website content or a Training is made available to you under alternate license terms, you may not distribute, sell, modify or otherwise provide access to such item to any third party.

In addition, for any content or Trainings, or parts thereof, which are made available under license by third parties, you agree to abide by any additional terms and conditions of the third party proprietary notices accompanying such content or Trainings.

The name, abbreviation, title, emblem and logo of ITU are protected under the provisions of Article 6ter of the Paris Convention for the Protection of Industrial Property. Consequently, neither the ITU name, abbreviation, title, emblem and logo, nor those of the ITU Academy, may be used without the prior written permission of the ITU.

The content and Trainings presented in this Website, including any designations  or denominations used therein, do not necessarily represent the views of the ITU or its secretariat, neither do they imply the expression of any opinion whatsoever on the part of the ITU or its secretariat concerning the legal status of any country, territory, city or area or of its authorities, or concerning the delimitation of its frontiers or boundaries. The term “country” as used in the content and Trainings also refers, as appropriate, to territories or areas.

4. Your Content and other user generated content

The Website enables you to upload and share the content you create (e.g. assignments, responses to questions or tests, posts and communicatoins with Training instructors or other users – collectively, “Your Content”). Unless otherwise agreed between you and ITU, you retain all intellectual property rights in Your Content, and you grant ITU a worldwide, fully-transferable, royalty-free, perpetual, irrevocable, sublicensable, non-exclusive license to use Your Content (including, copy, distribute, make available and create derivative works) to fulfil the Website’s educational purpose. This license is extended to any third party providers of Trainings you registered.

You are responsible for ensuring that: i. you own or control all rights in and to Your Content, including the right to authorize ITU and third party providers of Trainings, as described above; ii. Your Content does not infringe or misappropriate any third party rights, including any copyright, trade secret, moral right, and any other intellectual property right or privacy right; iii. Your Content does not contain any confidential information and it complies with all applicable laws, including those pertaining to defamation, libel, or obscenity; and iv. Your Content does not include any viruses, worms or other malicious code. ITU will not be responsible or liable to any third party for the lawfulness or appropriateness of Your Content or any other content posted by users on the Website.

ITU reserves the right, but not the obligation, to review and remove any of Your Content from the Website if it considers, at its reasonable discretion, that it does not meet the requirements of this Section, and to terminate or suspend your Account or use of the Website. Such actions are without prejudice to any other legal remedies to which ITU may be entitled to under applicable law.

5. (a) Use of your personal information by ITU; (b) your use of third-party personal information

(a) In addition to the terms of the general privacy notice, the following terms apply with respect to the collection and processing of your personal information by ITU. In case of discrepancy between the general privacy notice and these Terms, the latter shall take precedence.

ITU collects and processes the personal information you submit when you use the Website only to fulfil the purpose for which it was submitted. Such purpose depends on how you wish to use the Website: for example, ITU may process your personal information to finalize the creation of your Account, to complete your registration for a Training, to conclude a transaction (e.g. effect/receive a payment) or to provide you with specific content or information you wish to access. Sometimes other users of the Website (such as providers of Trainings or other Website users) may also submit information about you on the Website. ITU processes this information and associates it with the personal information you provide, only for the purpose of enabling you to use the interactive features of the Website (such as forums or chatrooms) and to fully participate and complete a specific Training.

As explained in our general privacy notice, ITU uses “cookies” to provide you with an enhanced and more personalized experience of the Website, e.g., by estimating usage patterns, customizing the appearance of the Website to your individual preferences, by remembering such individual preferences when you revisit the Website. You may opt to deactivate cookies completely through your browser preferences; however, this may affect the functioning or appearance of the Website. ITU may also process your Internet Protocol (“IP”) address and collect analytics data, or use third party analytics tools for the purpose of measuring traffic or usage trends of the Website.

In no event whatsoever does ITU sell or trade your personal information with others. ITU does share your personal information with third parties as described below:

  1. Information shared with third party providers of Trainings: When you register for Trainings provided by third parties, such third party will receive your personal information and process it to enable your participation in the corresponding Training. Regardless of whether such third party receives your personal information from ITU or directly from you (for example, if the Training outline mentions that a separate registration process is required at the third party’s website), the processing of your personal data by such third party shall be governed by that third party’s privacy policy, which ITU recommends that you review prior to deciding whether you wish to register for a Training.
  2. Information shared with subcontractors of ITU: ITU provides certain aspects or features of the Website through contractual arrangements with third party service providers, which it engages as subcontractors. In this context, ITU may share, to the extent necessary, certain personal information with those subcontractors, for the sole purpose of enabling your full and effective use of the Website. ITU has put in place contractual arrangements to ensure that any processing by ITU’s subcontractors of your personal information is done only for this purpose, in accordance with the relevant data protection legislation applicable to the subcontractor.

You may always access, modify the personal information pertaining to your Account, and you may request ITU (hcbmail@itu.int) to permanently delete your Account (including all personal information). ITU may retain certain information even after you delete your Account, only if reasonably necessary to comply with contractual obligations, resolve disputes, or enforce these Terms.

(b) When accessing or using personal information of third parties via the Website, you represent and warrant that you will comply with all applicable data protection and privacy laws and that you will refrain from using any such personal information in a manner not permitted by such laws.

6. Disclaimers; Limitation of Liability and Damages

ITU assumes no liability or responsibility for any errors or omissions and further disclaims any liability of any nature for any loss or damage howsoever caused in connection with using this Website and its content or Trainings.

It is possible that certain content or Trainings may contain links and references to third party websites, products or services.  ITU provides these links and references for your convenience only and so doing does not imply either responsibility for, or endorsement of those third party websites, products or services by ITU.

If you are dissatisfied with any aspect of the Website or any Training, your sole and exclusive remedy will be to stop using the Website and request ITU (hcbmail@itu.int) to delete your Account. Notwithstanding the generality of the foregoing, you agree that, unless otherwise stated in these Terms, you will have no claim or remedy against ITU arising from or relating to (i) Training modifications or cancellations; (ii) any failure of performance, computer virus or communication line failure, regardless of cause; and (iii) the actions or omissions of any third party arising out of or relating to the Website or its content (including, without limitation, any Website user or third party provider of Trainings).

In no event will ITU’s total liability to you for all damages, losses, and causes of action arising out of or relating to the terms or your use of the Website exceed the amount paid by you, if any, for accessing and using the Website during the twelve months immediately preceding the date of the claim. To the maximum extent permitted by applicable law, in no event shall ITU be liable to you or any third party for any indirect, incidental, special, punitive or consequential damages (including, without limitation, loss of use, loss of profits or revenues or other economic loss).

7. Terms applicable to Training Fees

Participation in certain Trainings may require the payment of Training Fees to the ITU partner institution providing the Training. Training Fees are displayed in US dollars (USD) in the ITU Academy Website, but payment may be possible in a different currency. Additional terms and conditions concerning the payment of Training Fees may be applicable between the ITU partner institution and yourself, as a Training participant.

8. Mode of communication

You are welcome to contact ITU at hcbmail@itu.int for any questions, queries or additional information you may require with respect to the Website, these Terms, or any inquiries pertaining to the Website content and the Trainings.

9. Disputes; Privileges and Immunities

Any dispute between you and ITU arising from or relating to these Terms shall be settled by an agreed mode of dispute resolution, including but not limited to, arbitration, which shall be the exclusive mode of resolving disputes hereunder.

Nothing contained in or relating to the Website, the Trainings or these Terms shall be deemed or construed as a limitation or a waiver, whether express or implied, of any of the privileges, immunities and other facilities which ITU or any of its officials enjoys by virtue of the international treaties and national laws applicable to ITU.
